Selectmen’s Meeting  Minutes
March 28, 2006

Present:        Christopher Colclough , Mark Gallivan, Jesse McSweeney and James Egan. Also present Executive Assistant Meredith Marini.   (Executive Secretary Michael Finglas - Absent)


7:30 p.m.       Chairman Gallivan called the meeting to order and lead the Pledge Allegiance.  He read the Public Announcements and upcoming meeting schedule.


Item I          Town Administrator SearchChairman Gallivan informed the Board that Town Counsel forwarded an opinion relative to the Board of Selectmen serving as the Screening Committee.  Kopelman & Paige indicated that Board could serve but recommending checking with the District Attorney’s Office.  Mr. Gallivan contacted the District Attorney’s office and was advised that the Board could not serve.  They did indicate that two members of the Board could serve on the search committee.  He recommended that the process be move as quickly as possible since Mr. Finglas’ current contract expires on June 30th.  Mr. Gallivan recommended the composition of the committee be comprised of two members of the Board of Selectmen, two members of public safety and a member of the finance committee.  Mr. McSweeney volunteered to serve on behalf of the Board.

MOTION by McSweeney, second by Egan to create a Town Administrator Search Committee comprised of Mr. McSweeney, Mr. Egan, Chief Savage, Chief Hoyt and a member of the Finance Committee.  Voted 4 – 0

Mr. Gallivan reviewed the previous search process outlining the application review, preliminary screening under exemption 7, ranking and finally the forwarding of names to the Board of Selectmen.  

The Board reviewed the draft advertisement.  Mr. Colclough recommended adding as an additional submission method, e-mail and fax.  The Board agreed the advertisement would be placed in the Globe and Hanson Express and on the MMA website.

MOTION by McSweeney, second by Colclough to approve the advertisement as revised.  Voted 4 – 0

Mr. McSweeney requested that the first meeting of the Search Committee be posted on Wednesday, April 12th  at 7:00 p.m.

Item II Disclosure  - Upon recommendation of Town Counsel, Mr. Finglas submitted a letter and disclosure regarding the search for a Town Administrator as he anticipates seeking the appointment.  He indicated that his intends to remain uninvolved in the search process and requested the Board Exempt him from G.L. c. 268A, Sec. 19.

MOTION by  McSweeney, second by Colclough to accept and file with the Town Clerk Mr. Finglas’ disclosure.  Voted 4 – 0

Mr. Gallivan commented that Mr. Finglas has done a great job as Executive Secretary and will make a good Town Administrator.  He feels Mike is a qualified candidate.


Item III        Executive SessionChairman Gallivan announced that the Board would be going into Executive Session under exemption #3 contract negotiations with non-union personnel.

MOTION by McSweeney, second by Colclough to go into Executive Session under Item #3.  Roll Call – Colclough aye, Gallivan aye, McSweeney aye and Egan aye.  Voted 4 – 0.

8:25 p.m.       Brief Recess

8:47 p.m.       Returned to open session

MOTION by  McSweeney, second by Gallivan to adjourn.  Voted 4 – 0
